So ,i think its time to retire my black victorinox that my dad bought me almost 30 years ago . The thought of losing it has been on my mind lately and how i couldn't replace something that has been with me through most of my life . I'm leaning towards a folding blade SOG and i wanted to know what is the legal length to carry in NYS. Thanks in advance

I had some cabelas gift cards burning a hole in my pocket ,i went out this morning with the intentions of buying a SOG , after checking some out ,they just didn't have what i wanted(size ,spring assist and partially serrated blade)  I did find a nice Benchmade 585 that fit the bill so i found my new pocket knife . Maybe some day i can hand down the victorinox to one of my unborn kids.

Benchmades are very good knives , they use a color code that basically is a quality level, although even the lowest ones are better then most box store knives.

For 5 bucks they'll sharpen it and go,through it to make sure it's up to factory specs. For $35 they'll replace the blade ( or did in the past) I beat the crap out of my 710 for years and years , $ 35 and I got a new blade ($150 for a new 710 btw).

The Axis lock is really strong, 154 cm is a great steel , Knife of the year in 2,009 and made in the U.S.A !

Nice choice enjoy !

Here is the color code

thought it was 4 inches and couldn't be spring assisted. I have since only purchased full tang.

prolly just down in the city. I was told if its longer than that then as long as you are going camping / hunting / fishing / Hiking (outdoor activity requiring use ) then you are good to go as long as you don't make and stops in between.

technically I cant even take it in to get sharpened. which I think is dumb.

oh but I can carry an axe around and be perfectly legal

Who knows when it comes to NYC….I heard, a while ago that the good comrade wanted to make any folding knife illegal, based on some crazy liberal interpretation that would make any folding knife a gravity operated knife. But as far as the rest of the state….for now…blade length, alone,  has nothing to do with whether or not a knife is legal.

Full tang is a fixed blade knife where the tang goes all the way through the handle.

As far as NYC ,can not be carried in the open . If the clip,is showing they consider that open carry. If an officer can inertia open it they call it an illegal gravity knife , which is incorrect.

A gravity knife of which the German paratroopers knife is THE classic one , opens when a button is pressed and the knife turned upside down , ie gravity opens it .....

There are cases where it took the officer many tries at full force before he could " flick" it open , hardly a " gravity knife " or perhaps NYC has a gravitational force far greater than planet earth .... C

When I'm in NYC something I avoid as much as possible , I tighten the pivot and pocket carry.

The two main illegal folders in the state would be automatics ( silly and moot with the one hand openers of today) and double edge . Right now I'm carrying a Microtech out the front auto with double edge !

Made in America and darn fun to play with , hey Jack Bauer carried one !

  • It is illegal to own a pilum ballistic knife

It is illegal to own a metal knuckle knife

It is illegal to own a cane sword

It is illegal to own throwing stars

It is illegal to own any knife if you are not a U.S. citizen

It is illegal to own any knife adapted for use primarily as a weapon

It may be illegal to own a gravity knife, without a valid hunting and/or fishing license

It may be illegal to own a switchblade knife, without a valid hunting and/or fishing license

New York does not have concealed carry laws, therefore it is legal to open or conceal carry any knife that is legal to own and that the carrier does not intend to use unlawfully against another.

The gov't cuts it up for them in to little bites ,blows on it so its not too hot and then finishes off with pretending its an air plane coming into hangar and just maybe makes the sound vrooooomm while doing some aerial acrobatic stunts on its final approach into the hangar .

This is taken off a web site that is not complete or acurite . Try open carrying a common folder in NYC 1,000s have been arrested for it. So many that many knife companies won't ship ANY folders to a person In ANY part of the state . I just had two Spydercos shipped to N.C. For re shipping to me in Western NY.

The auto knife and hunting is NOT if you have a hunting Lic. But only while doing so and that's still a bit of a grey area as well. I could go on but I got meat on the grill...

Here's the definitions from the NYS Penal Law........

4. "Switchblade knife" means any knife which has a blade which opens
automatically by hand pressure applied to a button, spring or other
device in the handle of the knife.
5. "Gravity knife" means any knife which has a blade which is released
from the handle or sheath thereof by the force of gravity or the
application of centrifugal force which, when released, is locked in
place by means of a button, spring, lever or other device.
5-a. "Pilum ballistic knife" means any knife which has a blade which
can be projected from the handle by hand pressure applied to a button,
lever, spring or other device in the handle of the knife.
5-b. "Metal knuckle knife" means a weapon that, when closed, cannot
function as a set of plastic knuckles or metal knuckles, nor as a knife
and when open, can function as both a set of plastic knuckles or metal
knuckles as well as a knife.
5-c. "Automatic knife" includes a stiletto, a switchblade knife, a
gravity knife, a cane sword, a pilum ballistic knife, and a metal
knuckle knife.

The above is true and contains so much " fail" it makes ones head spin. Stiletto is a style of knife NOT a means of opening , a gravity knife opens by well gravity not centrifugal force . Only in NY is gravity and centrifugal force considered one and the same . Where is Sheldon when we need him ......,

Personally I ignore it all and carry what I want , worked well for decades .

I think and I may be wrong, that in NY the term "Stilleto" (right or wrong) means the blade shoots out the front of the handle, while the "switchblade" flips out from the side when the button is pushed in, activating the spring that opens the knife.....

So would a Benchmade Emissary 470-1 be legal??

http://www.benchmade.com/products/470-1

And I don't mean NYC, just a local guy in WNY............thanks for the legal help.  :)

As long as the blade doesn't  completely open and lock into place, with the push of a button ….you are good. If you have to "flick" it or manually open it all the way ..its good.
