3S - 8 point roadkill (route 134)

I don't know the rules of taking antlers from roadkill bucks, but for those interested there is a beautiful 8point (at a minimum) on route 134 west between the taconic and 9A in Ossining/Yorktown. I drove by it this morning just before 8am. It looked to be still in velvet.

there are plenty of large bucks down here...problem is many of them live in neighborhoods with 1/2 ac. lots or along side highways...they are unhuntable.  

 

but there are still a good number of large deer that are huntable, it just take many days in the woods and many different spots need to be checked before you can find them

Must have been a trophy, I just know you say there are no trophies in that area in hunting season so i was kinda wondering if they were there in the summer. Guess they are.

3S is filled with monsters including the NYS record typical archery I believe. Westchester is bow only and probably ranks up there as one of the best units for big bucks in all of NYS

It is illegal to take any deer without a tag or permission from DEC. The legal thing to do would have been to call DEC or trooper for a tag.

what this guy said. although i do view this as one of those "who am I hurting" rules. But if you get caught with a shed full or horns you better have tags to prove you didn't poach them... and also don't make a dangerous road hazard out there either.

I agree with this.  Question though, are we supposed to keep tags from bucks killed in seasons past?  I haven't up until now.  They generally get discarded after processing or when I pick up the mount.  If not, how does DEC prove that an antler or mount in your house is from a poached deer?

Most would do as you do, discard the tags. But if I was hunting for horns, I would defiantly keep my tags tucked away inside my mounts. Works great as a reminder of when and where those horns came from when you're old and senile.

i keep tags with meat until gone. I'm sure there's a rule somewhere but I don't believe you're required to keep it beyond then. I do believe the DEC would have your records in a database after reporting though. I think mostly it's a harmless issue but any "fresh" racks might raise an eyebrow if for some reason an econ officer visits your barn.

With road kill it is illegal to take any part of the deer except for the antlers, unless you have a tag.... If you saw off each antler individually it is ok but if you take any part of the skull plate you are breaking the law.... I know this for a fact because a friend of mine learned this the hard way and and had to go to court.

i'm not saying you're wrong, but i wouldn't believe anything until I see it written in a reg somewhere

Here is what the DEC had to say when I emailed them about this topic last spring after I found a big deadhead buck while shed hunting...

 

The DEC's answer:

Any part of the deer other than antlers? Where do I turn myself in for the dozen or so tails I clipped off road-kills over the years to make fishing lures? One time I got more than I bargained for and the big "dead" doe jumped to her feet when I touched her tail. Since I already had my knife drawn, I jumped on her back, put her in a hammer-lock, and slit her throat. After she stopped flopping around on the snow, creating a scene like a bloody massacre in the fellas front yard, I threw her in the back of my pickup and drove directly to the town police station.

I asked the desk officer for a tag. Someone had already called in the "road-kill" earlier. As I stood there, bloodied up a bit, he asked if the deer had to be shot. When I told him: "no, I killed it with a my knife" (a 1-1/4", lock-blade), he said: "that would be no". Then he gave me a carcass tag. Our freezer was already full, so I gave this one to a friend. He dropped it off at a butcher who said that was the cleanest deer he had ever cut up.
