Sure leaves a lot up to the imagination doesnt it?

here is DEC's dscription.  The link to the source as well.http://www.dec.ny.gov/outdoor/33067.html

Artificial lures or bait means artificial imitations of natural bait, man-made flies, spinners, spoons, plugs, jigs and other lures including those that may contain some natural substances such as deer hair and feathers.

Artificial fly means a hook with no more than two points dressed with feathers, hair, thread, tinsel or any similar material to which no additional hooks, spinners, spoons or similar devices have been added.

I have never understood the concept myself, you cant use a nightcrawler for example but you can use some type of synthetic worm covered in scent that looks, feels and does everything to attract fish except wiggle.  What is the purpose?  If its to deter bait fisherman from certain areas for flyfisherman than just post it for fly fishing only but in the same respect why is there not a bait fishing area only in return?  Got to love NY state thinking.

This question was raised on the forum a couple of years ago and I do not remember there being a definitive answer.

These regulations were instituted before modern "biological" type man made baits such as "Gulp" even existed, and have not been revised to cover the new developments. Technology of plastics such as "rubber worms" was in it's infancy when these ALO waters were defined. Artificial lures at the time meant basically spoons, spinners, plugs and flies.

I do know a number of people who regularly fish ALO waters with baits such as "Gulp" leeches, and have not heard of anybody being pinched for it.

Because in"political speak" the above would look as discrimination between a type of "fisherman" in stead of a type of bait....lol ;)

That was my point in a different version lol.  A fisherman is a fisherman in my book, well unless it is a women then they would be a fisherwoman lol.

Most ALO areas are also catch and release areas. Or like you can't use live bait for bass til June 15. Live baits usually result in a deeper hook that's harder to remove, and usually ends up fatal for the fish. It's not a discrimination towards fly fishermen over bait guys at all.
