The State Rifle and Pistol Association has filed a notice of claim to overturn New York’s sweeping gun control law, the NY SAFE Act. The claim takes issue with the gun control law and its updated ban on assault weapons, challenging the constitutionality of the measure. In the notice of claim, the association says the law violates the U.S. Constitution’s Commerce Clause, as well as violations of due process and unlawful seizure of property. The law has new restrictions on the private sale of firearms and requires registration of previously unregistered assault weapons. The claim also says that “the legislation is impermissibly vague and overboard.” A claim like this is generally a precursor to a full-blown lawsuit.
