If you sell A gun, the answer may be yes.

 

“We will be looking for those individuals who seek to avoid registering,” Attorney General Loretta Lynch told reporters following a Jan. 4 meeting with President Obama regarding executive gun control.

Lynch was referencing the portion of Obama’s pending executive-action gun-control measure that will require gun-sellers to register as federally licensed gun dealers if they meet criteria demonstrating they are “engaged in the business of dealing in firearms.”

This language also means that private sellers registered as federally licensed dealers will have to perform a background check on every sale.

One problem is that the White House executive action fact sheet does not present any numerical minimum on the number of sales that a private seller must conduct before he is considered to be “engaged in the business of dealing in firearms.”

Rather, it indicates a private seller can be considered to be “engaged in the business of selling firearms” regardless of the location from which she sells, the frequency with which he sells, or the number of guns she sells.

In light of this, CBS News reports that Attorney General Loretta Lynch is making it known that the ATF will be watching and looking for private sellers who “seek to avoid registering” as being “engaged in the business of selling firearms.”

Lynch stressed that an “exception” remains for “the hobbyist and collector,” but the executive order means private sellers cannot continue to “hide behind that [exception].”

Translation:  “We will use this new executive order to mean whatever we want it to mean when we come for your guns.”

That my friends, is the real reason for Obama's "executive order".  Regardless of what supporters think, this is very bad legislation, and it just might get a lot of people killed.

I'm a bit confused... sell a gun you must be an ffl. to be an ffl you have a buisness. if you spend the time and money to get an ffl you need to sell more guns to pay the fees. the more guns you sell the more guns in public..... the more they spew about gun control the guns are bought.... these people are idiots... although it would be nice to have a gun store on every block in town and in every apartment building in the country!

Who's definition of being in a business? If I can't deduct it on my taxes or have to pay taxes on the income then I'm not in business. That's the governments definition not mine.

The IRS presumes that an activity is carried on for profit if it makes a profit during at least three of the last five tax years, including the current year 

  • Does the time and effort put into the activity indicate an intention to make a profit?
  • Does the taxpayer depend on income from the activity?
  • If there are losses, are they due to circumstances beyond the taxpayer’s control or did they occur in the start-up phase of the business?
  • Has the taxpayer changed methods of operation to improve profitability?
  • Does the taxpayer or his/her advisors have the knowledge needed to carry on the activity as a successful business?
  • Has the taxpayer made a profit in similar activities in the past?
  • Does the activity make a profit in some years?
  • Can the taxpayer expect to make a profit in the future from the appreciation of assets used in the activity?

Even if every firearm you ever bought or sold, or will buy or sell, used a licensed FFL dealer, under this new "Executive Order", you may now be subject to scrutiny and inspection by the BATFE at any time in the future.

 

Those 200 new agents are going to be talking to people who sell guns now.  And they are going to say you "may" be in the "business" and they want to inspect your home and your firearms.

 

Should you refuse to cooperate, things will go very badly for you.  Should you decide to fully cooperate, you may see yourself cited for a violation of FFL rules and have your entire firearm inventory confiscated.

 

It will be on you to hire a lawyer, absorb huge legal fees and prove your innocence.  

 

Years later you may actually have your guns and your rights restored.  This is what Obama has implemented.  Give it time if you think that's not the case.
