Mixed emotions on this, I don't like the idea that someone that doesn't even have a legal right to be here gets a driver's license (and did I hear right, that they are free?), but I also think that county officials have an obligation to be lawful, not make up their own laws.

They do have a right, and a legal responsibility, to challenge any laws they feel are illegal.  The clerk's lawyers will sort it out.  It's not as if they don't have legal standing against this law.
