Our Children’s Trust and the so-called “Climate Kids” claimed that young Americans would face future harm caused by older generations. Rising tides, wildfires, hurricanes, and mass food shortages would be their undeserved inheritance. And the court bought it. That is, Magistrate Judge Coffin ruled that the kids had standing to bring the suit. The Feds’ motion to dismiss was denied. Here’s the thing: Surviving that motion to dismiss wasn’t easy. The D.O.J. argued forcefully that there is no constitutional right to a pollution-free environment. The court characterized the plaintiffs’ theory as something “novel,” a cross between a civil rights suit and a Clean Air Act/Clean Water Act claim. Many courts would have been reluctant to enter this new legal territory. The key issue before the court was standing. As Judge Coffin wrote, federal courts are not the forum for airing generalized grievances about federal policies. To establish standing, the Climate Kids needed to allege an injury that was concrete, imminent, and particularized. Youth helped them show particular harm. Climate change affects all of us, but the plaintiffs contended that it will affect them more and for a longer period than older folks (who will no longer be around). The kids also needed to counter the argument that their case was premature. Judge Coffin admitted that the claim was “nascent,” but ultimately found this to weigh in their favor. The court should not delay the case simply because society is continuously learning about the human causes of climate change. The lawsuit should continue in order to further develop the record and determine the facts. In short, the Climate Kids were allowed to keep fighting. That in itself is a really big deal.?

You mean the Judge Palin (http://www.people.com/article/sarah-palin-tv-judge-show) effect since she has no law degree and Judge Judy does. I have no legal expertise but i can read and understand. So I read and understand papers written by judges and lawyers. 9 out of 10 say they are fools without a leg to stand on the 10th had a squirrel run up his leg.

Oh those darn Bundy's at it again! Just like a sad situation comedy where Jr keeps getting into the same kind of trouble again and again, here we go again! Bundy's defense for an armed occupation of a federal building is to challenge the right of the Federal Gov't to own land which has been settled by the SCOTUS not once but twice before. But hey what do judges who studied law for years know? We all need to check ourselves when we leave the woods and again when we get home. Often they can be on your clothes or in your car and not attach until several days later. I treated the seats of my car with permethrin every three months, spring, summer, and fall, I am always careful with the clothes I wore afield so as to not get ticks on my couch or house. Rob, mine was dead center below the belly button join the club!

I should have said "killing of unarmed black people", mea culpa. Imagine if a black person had done the same thing and said the same words as Finicum did that day. Do you think he would have made it to the second road block? been able to reach for this side arm twice? or even been able to walk as far from his vehicle as he did before being shot? I watched the video and I was shocked at the way he spoke to the law.

Yes, unfortunately the "Law" is always in that sort of crossfire which amplifies any appearance of misconduct or improper procedure. The reality is the Michael Brown killing touched off a powder keg of built up emotions involving the killing of black people. I got the sense it was seething below the surface of that community for a while.

Oh if it could only be like that Ants, certainly I want law and justice to be applied evenly and often it is. Perhaps most disturbing is that there is video tape evidence of Finicum threatening violence and saying he won't be taken alive. Additional video of him running two roadblocks threatening more violence by "people who are coming" to the scene of the roadblock, leaves his vehicle demanding to be shot and reaches for his side arm twice before being shot. So what do some people say? Conspiracy, Gov't cover up, assassination. Death threats are being made against nearly everyone involved including the judge and prosecutor. The cop who shot Finicum is trying to keep his name private because of death threats. Threats still continue against the wildlife refuge workers who did nothing and took 41 days off while the occupation went on. Some people on this very site told me the police road blocks we set up wrong and in wrong places like that proved that it was an assassination.

Such a poor misguided woman. Ignoring the facts that have been put out there because they don't suit her. When someone commits suicide by cop there are many victims and clearly she is one of them. Too bad she doesn't speak so strongly for the many others who are shot but are completely unarmed and not reaching for a gun after having promised to not be taken alive, Where are all the Papist's people of the world who have stood up for cops before saying how hard a job they have, how they are in constant danger from gun toting criminals.

I'm not going to argue the point that some mining is more acceptable than other mining because of need. EVERYONE one is like that not just "Eco" people. The fact is most people never think about the mining involved for their products period. Where as mining for energy is always in the news in some sort of way. BUT, I will argue your position that strip mined land cannot be reclaimed (https://pubs.ext.vt.edu/460/460-123/460-123_pdf.pdf) and that the future will bring a "complete "green" disaster". Both of which don't seem based on fact. -
I wonder if timing of this question to consumers is just as important as the question. Asked just after an item recently purchased breaks I'd bet more people would opt to pay more.

I'd say all mining is condemned as no mining is without environmental hazards. But tell me as I have not been able to find mention that lithium mining is more environmentally disastrous than other mining. BTW have you pitched your lithium powered devices?
