Under current NYS law would that be legal? If "Yes - it would be legal", would it still be legal with both the thumbhole stock and an extended magazine tube (+2 rounds to make the gun 6+1)? I can't remember honestly if there is a 10 round limit on ALL firearms in the state or not now, regardless of semi-status. But, you can also build a fully featured AR with flash hider, pistol grip, foregrip, whatever you like as long as it isn't a semi (e.g. a pump AR and yes they do exist) OR as long as it doesn't have a detachable magazine (e.g. glue the mag release and then you have to load by pivoting the upper). But remember….A semi automatic shotgun, with a pistol grip stock is legal but the same shotgun with a thumb hole stock is an "assault weapon"…Because thats "sensible" LOL!!!
