Warren Posted February 28, 2011 Share Posted February 28, 2011 It's been many years ago that I got mine but I think the acceptable reasons for wanting a pistol carrying permit have not changed that much. I would think a good reason for a carry permit would be for hunting and target shooting. I was under the impression that NY only had 2 kinds of pistol permits - (1) on premise only and (2) full carry. I don't think you need to convince anyone that you need to carry all the time to get a full carry permit and I can't see you being turned down for wanting to hunt with a handgun. 2BRKnot2B Posted February 28, 2011 Share Posted February 28, 2011 It depends on what county you live in. Try getting a CCW in Saratoga County when saying you want it for personal protection carry. They'll take your money, but if you don't check hunting, and target shooting, forget it. Of course, the legal aspect of this is a no brainer. You simply always, either going hunting, or going to the range. Remember, you don't have to go to a certified range. The range could be a nearby field at which you are going to shoot. You're carrying at work to shoot someplace afterward. You're going hunting, but it's after dark? Well, you were going to, but things at work got out of hand, and you couldn't get out in time. Weekend at the mall, you wrre going shooting afterward. Dark out already? You were at the place, but didn't get a chance to shoot, or leave a little powder in the barrel so you can say you were already shooting and are on your way home. It's a mere technicality meant to make the judge sound reasonable in issuing your permit to you. Some don;t want you carrying all the time, and think self defense is BS. Warren Posted February 28, 2011 Share Posted February 28, 2011 fisher2 - Why would you get pulled over? As a ccw holder I would assume you follow the laws (sorry, that's the dad in me). If I was pulled over (with a gun or without) I would make sure I had both of my hands in clear view for the officer to see and I would not make any quick moves. With the age of the computer I'm sure the officer will already know if you are a permit holder or not. I don't think you have to tell them you are carrying unless you are asked. Just google this subject, there is plenty of good advise on the subject. Sounds like you might look into taking a handgun safety class where you can get these questions answered, don't take our word for it. This might be a requirement for the permit anyway. WNYBuckHunter Posted February 28, 2011 Share Posted February 28, 2011 I have gotten pulled over with my gun in the car and have never had to show the officer my permit, or even been asked for it except for a couple of times when I have used it to put down a car struck deer. The officer asked if I had a permit, I showed it to them, they told me to go ahead and I went on my way. I have heard that nobody gets an Unrestricted without being a police officer....however, you can apply for an upgrade from your "Hunting and Target." My "Additional Cause" for wanting an upgrade is 2 things. 1. When I drive 4-5 hours in the middle of the night to go fishing, and then walk into the woods in the pitchblack. I am not hunting or target shooting, so I cannot carry unless I am given the unrestricted. 2. When I stay in a hotel/motel overnight to go hunting. I cannot carry the pistol into the hotel with me, so I would have to leave my pistol locked up in my car through the night, till the morning when I can carry it out hunting. We'll see what happens....I am in the process now. PROPER CAUSE FOR ISSUANCE (LICENSE TYPES) Hunting and target – [/size]Firearm may only be transported directly to and from your residence and an authorized range or while actually afield hunting in a legal area in New York State. (For hunting, you must also possess a valid New York State hunting license.) Business Purposes – [/size]Firearm may only be carried while actually engaged in conducting business for which the license was issued or traveling directly thereto or therefrom. (Requirements for a business carry license follows.) Unrestricted Carry – [/size]You must be a police officer or peace officer (active or retired) or [/size]you must show “additional proper cause” [/size]to qualify for this endorsement. “Additional proper cause[/size]” is determined by a review of all relevant information of your claimed need. You should apply McDonald, and Chwick arguments to the case. Both argue that a county cannot make laws against the laws of the state, or in addition to it. I know different counties do have different rules...Dutchess ( the county just north of Putnam) only gives full-carry no restrictions....westchester county (just south of putnam) is almost impossible to get a permit, and NYC is forbidden....these 4 regions are all within 50 miles of each other.
