Sen Gillibrands Gun laws ?

So Sen Gillibrand want's to make gun trafficking a federal crime.

She states that it's a misdemeanor if your caught trafficking and selling an illegal firearms across state lines, yet in NY.......

As of March 2013, what used to only be a misdemeanor crime is now a felony offense in New York State. If you are arrested with an unlicensed or unregistered firearm, a pistol or revolver for example, in New York City, Queens, Manhattan, Brooklyn, White Plains, Yonkers, New City, Poughkeepsie, Beacon, Nyack, Carmel or any other municipality, the police and prosecutors can arrest and charge you for violating New York Penal Law 265.01-b(1). Adding to the list of what is arguably to strongest and most severe weapon crimes and laws on the books, PL 265.01-b(1) is a class “E” felony punishable by a sentence of up to four years in prison.

Although the pistol or revolver you possess may be loaded, and thereby expose you to the even more serious violent offense of Second Degree Criminal Possession of a Weapon, New York Penal Law 265.03, it need not be. For the purpose of NY Penal Law 265.01-b(1), the firearm in question need only be operable and your possession is unlawful in that it is not registered or permitted in the jurisdiction of your arrest.

In New York, it is a "felony" offense for someone who is not legally authorized to have a firearm to sell, exchange, give, or dispose of a firearm or a large capacity ammunition feeding device, or possess a firearm with the intent to sell it. This offense is known as criminal sale of a firearm in the third degree and is punishable by up to seven years in prison.

So, now we have more NY dingbat politician's that are trying to look tough on crime, when they defunded + disbanded the Law enforcement Unit's that actually removed illegal firearms from the streets of NY state and won't enforce the laws that are already in the books anyway.

Is Sen Gillibrand trying to outshine Cuomo ?

Requiring a firearm to be "licensed or registered" turns a Constitutional right into a state granted privilege.  Many American citizens are not allowed to register a gun in NY, because they don't reside in this tyrannical state, or the state has deemed them ineligible for any number of arbitrary reasons.. 

Notice how the law targets anyone in possession of an unsanctioned firearm, rather than only convicted criminals in possession of a firearm.  The law is designed to ban guns in your hands to defend yourself.  Criminals don't follow gun laws because gun charges are plea bargained away to get the perp to plead guilty to the crime they actually committed with the firearm.  And that often results in less time in prison.

But if you are not committing a real crime, the law makes you a criminal for possessing an unsanctioned object the government wants to deprive you of.
