  16. nope, saw three guys in court today with lawyers for getting written tickets for "deer hunting" over a cut corn lot not attempting to harvested all got guilty....guilty....guilty $250.00 a piece. After the attorny told the judge that there was no difference in the standing corn that was legal to hunt and the corn that was "mowed" down the Encon officer spoke to the ADA stating that hunting deer in their normal state of browsing standing corn was different then when it is cut and on the ground where deer would congrigate and have the chance of passing diseases by eating off the ground. Judge liked it and fines stood.

I know this subject had been talked about briefly but when talking about a cornfield that has been just "roto chopped" with no attempt to collect the corn would you consider this baiting when dealing with deer only. I know its against the law for waterfowl where every attemp must be made to harvest the crop.
  18. I'm too busy deer hunting to argue about DWI's and where when or why you should or should not get one. Like MarcyGirl said don't drink don't get a DWI end o' story.
  19. Marcygirl i completely agree with you. but if someone does choose to drink and knows its not a good idea to drive and does the right thing by sleeping it off whether its in the back of their pick up truck or in the back seat of the car i dont see any way a DWI can be given.
  20. Like I said in previous posts you have to have the keys in the ignition "running" with intent to drive "or as the article says "be in control of the vehicle"
  21. WNYBUCK, NO YOU CAN NOT! Trust me i know. I dont know where you get your info but def. dead wrong. You cant be on private property and be arrested for a DWI.
  22. in most cases i would say the reason the police would even be there to investigate was that they received a call about the person driving "recklessly" in that case as long as a witness can prove that the person behind the wheel was actually the operator at the time and is willing to fill out a 710.30 statement form and sign it then yes he can be arrested. Otherwise no if its private property he or she cannot be charged with a DWI
  23. haha, well hope he has a good attorney because in NY state you can not receive a DWI on private property ie:private bar parking lot and the car most def. needs to be running. Your friend got the Sh** end of that deal.
  24. You cannot get a DWI just because you are in your car sleeping off a hang over and the keys are in your pocket. You have to have the intent to drive. Meaning the vehicle first must be running and second must be on public property.
  25. Wow! Think the two of you should step away from the computer for a bit and go hunting being that it is the season and all....
