Town of Deerpark rejects NY Safe Act

Recommended Posts

Kudos to the Town of Deerpark, a town in western Orange County, who rejects the NY Safe Act by resolution. We need more town/villages/counties to reject this insanity that will cost from what I'm hearing 35 million to administer it.

is that even allowed?

Actually, it is. Under a little known (And very forcefully politically hushed in places like NY and California where the State is king) doctrine called nullification. Municipalities refusing to enforce a law in great enough number will render the law invalid, and thus nullified. Jury nullification works in the same way. But it has been ruled that the representatives of the State have no responsibility to tell you as a juror about jury nullification, and since he Prosecution doesn't have to tell you, the defense is sort of de facto prevented from informing the jury. Just another case of the state looking out for itself. However, in Jury nullification, juries are to be the arbiters of fact and law, not just fact. Jurors can -- AND HAVE -- nullified unjust laws in the United States, and in many countries which use the common law system. So, remember that next time you're on a jury. YOU ARE THE FINAL ARBITER OF FACT AND THE LAW.

Jury nullification occurs in a trial when a jury acquits a defendant they believe to be guilty of the charges against them. This may occur when members of the jury disagree with the law the defendant has been charged with' date=' or believe that the law should not be applied in that particular case.[/size']

A jury verdict contrary to the letter of the law pertains only to the particular case before it. If a pattern of acquittals develops, however, in response to repeated attempts to prosecute a statutory offence, this can have the de facto effect of invalidating the statute. A pattern of jury nullification may indicate public opposition to an unwanted legislative enactment.

This is our last best hope in getting these idiotic laws recently passed overturned or just outright thrown out/retracted. Towns/municipalities refusing to enforce them. Or in the case where the State picks up the prosecution, juries refuse to find the defendant guilty, regardless of the amount of evidence against them. We as citizens of the United States have a CONSTITUTIONAL DUTY to disobey unjust laws.

If someone doesn't comply with the registry of their "assault weapons", will they be illegal weapons, or will Democrats insist on calling them "undocumented weapons"?

Apparently, in the minds of the liberal loons, they will be considered "illegal", and they will be confiscated.
