The lower courts have been at odds to date in their decisions on state laws similar to the SAFE Act and only a ruling by the SCOTUS will resolve the issue. That being said, the courts have become quite political and activist in recent years, often violating the Constitution in their opinions. How do you find a "right" to gay marriage in the 14th Amendment but not find arms rights in the 2nd? The abortion "right" was literally created by the court using the "privacy clause" of the 14th Amendment and egregiously extending it to infanticide if done inside the womb. Further proof of the court's corruption is clear when the appointment of Supreme Court Justices is based on their political beliefs, rather than their legal beliefs. Plus, elected official's selection of political peers to fill Justice positions, while attacking sitting Justices who oppose their political beliefs, further proves the Constitution is NOT being adhered to in many cases. Both political parties have been equally guilty of violating their oaths, and the constitution. But in the 2nd Amendment case, Democrats have been the major offenders. Scalia's death was quite a coincidence considering the agenda the court has to handle in the near future. Unless Hillary is prevented from becoming President, the Constitution will be eviscerated and inalienable rights will all be regulated and infringed into obscurity, achieving the long desired leftist goal of unlimited government power. This will be the defining election for the future of America.
