Utica Homeowner Kills 2 Burglers, Gets Charged With Felony

Guy was burglarized about two weeks prior, they found a bunch of his stuff at one of the suspects home. Guys was so poor, he couldnt afford water or electricity,  so the county took his home from him as well. Case study in why this states pistol permit laws are so messed up, if he couldnt afford water and electricity, how was he going to afford to register the family heirloom his late father left to him? By all accounts, he would have passed the background check, he just couldnt afford the process financially.

County DA said it was inappropriate to charge him with a felony,  if anything he would only go misdemeanor as he was just defending himself in his own home. Sheriff didnt even want to arrest him. Troopers got involved and threw the book at this poor man.

I know the law is the law, but what the hell happened to prosecutorial discretion? It sounds like the damn pistol never left the house, and would have never left the bedroom had his life not been threatened.

Such a sad state of affairs we live in. Guy could serve 4 years in prison because he used a gun that he couldn’t afford to have licensed to save his own life.

Requiring a license to own a firearm is unconstitutional.  Requiring registration of a firearm is unconstitutional.  

Why are these laws in effect?  Because people have allowed the government to usurp their rights with unconstitutional laws.

Bernard Goetz was convicted of having an unregistered firearm as well.  He was convicted of nothing else.  

If these men defended themselves with knives and killed these criminals, they wouldn't be charged.  But because they used a firearm, they are criminals.  Since when does the use of a particular object for defense, determine whether you had a right to defend yourself from being killed?

The jury should find him not guilty because the law is unlawful.  It's called Jury Nullification.  You cannot be found guilty of a crime when you violate an unlawful, unconstitutional law.
