Bait laws?

I know that you can not hunt over bait with big game. I was looking at the laws on the New York DEP website and I didn't see any laws on bait hunting small game. The red squirrel and woodchuck have no season and no limit. I have tried to get an elusive woodchuck for a month or two maybe. I was wondering is there bait laws for small game hunting or just big game hunting? Or did I misunderstand anything like if there is just no such thing as bait hunting?

Nothing written on it being illegal for small game.

"It is illegal to hunt with the aid of bait, or over any baited area when hunting big game, upland game birds, turkey or waterfowl."

But we do have laws against "feeding" deer and bear. Could some aggressive and picky (trying to use nice terms here) CO claim that your bait was intended as deer or bear feeding?

I believe you can bait small game, but not turkeys of course. I know guys that bait coyotes and sit over bait piles and carcasses for them.

If you can't find it in the regs, just shoot the DEC an e-mail.

Thanks guys. That woodchuck has been asking for trouble eating up the tomatoes out of the garden. I want to try and throw a broadhead into that little bugger. I know they like cantelope and I dont think much other wildlife like it too much.
