Could you be charged with hunting over a pre-establish bait pile. if deer are feeding out of a birdfeeder in someone’s yard. Just something to think about. NFA-ADK Posted October 4, 2016 Share Posted October 4, 2016 Yes! If you are caught in an area with a barbeque you can get charged for baiting bear too. Any food that is not removed where you are hunting including bird feeders are considered baiting. Same on state land where poachers put out food, if you see it you need to report it and move out of the area. If you get caught by a bait pile regardless if you put it out or not you will be charged. growalot Posted October 4, 2016 Share Posted October 4, 2016 Actually as the law use to state and they have tried prosecuting at least once ..if I recall...you can be fined for deer eating out of your feeders...which is why they have pamphlets out that say when to put bird feeders out..Also a note...if a bear becomes a nuisance and is needed to be put down...if traced back to your feeders...you can be charged...That came up in a "living with bears" seminar the DEC gave our town...They then got a call to put down a bear one road over from our place...tearing up a garage...It had been hit by a car breaking it's jaw,was starving... chas0218 Posted October 4, 2016 Share Posted October 4, 2016 I would believe it, buddy had a trespasser a couple years back put out an electric feeder about 60 yards into a thicket from him. DEC came walking out straight to his stand, asked him if he owned the property and starting writing a ticket. Well my buddy had a trail cam in the area and they checked it saw it wasn't my buddy and the DEC officers took the feeder and didn't ticket my buddy.
