  1. A project we did in Northern NH ran through two winters with very deep snow. The moose would hit the snowmobile trails and use them. It was easier than the deep snow for them. I bet encounters could be common on the trails. Too bad this one turned out like this.

  5. Rather than talking in gray terms why not specify what you think that "legal trouble" would be. If a person acts reasonably and within the law there still could be a chance that an over zealous prosecutor could bring charges. You could incur legal fees to defend your actions. That is something that everyone has to weigh in their minds. I am prepared to take that risk in my home and out of it if I see someone getting raped. I have a very good friend of mine that was raped and two people in fact walked by and chose not to get involved. The guy was never found. Decide if you would want that for a member of your family or a friend. For those that want to read for themselves. Here is the section for justifiable use of DPF against a commission of a rape. 2. A person may not use deadly physical force upon another person under circumstances specified in subdivision one unless: (a) The actor reasonably believes that such other person is using or about to use deadly physical force. Even in such case, however, the actor may not use deadly physical force if he or she knows that with complete personal safety, to oneself and others he or she may avoid the necessity of so doing by retreating; except that the actor is under no duty to retreat if he or she is: (i) in his or her dwelling and not the initial aggressor; or (ii) a police officer or peace officer or a person assisting a police officer or a peace officer at the latter's direction, acting pursuant to section 35.30; or (He or she reasonably believes that such other person is committing or attempting to commit a kidnapping, forcible rape, forcible criminal sexual act or robbery; or © He or she reasonably believes that such other person is committing or attempting to commit a burglary, and the circumstances are such that the use of deadly physical force is authorized by subdivision three of section 35.20.

  7. I was going to Elmer. As an example though I used the rape instead because i thought it would be clearer that a rape was taking place as opposed to a robbery. Guess I was wrong
  8. Apologies. It was another member. What part of justifiable use of DPF concerning rape don't you agree with me on then since you have it
  9. Currently on my phone. I will post the law for you tomorrow. I have spoken with police and defense attorneys about multiple issues including this one. DPF carries no requirement to do things like presenting yourself or giving notification in a case of rape. Contrary to what you alluded to for in home DPF also. Have you asked?

  11. First. I think you are encompassing two different scenarios in your post. In your home and out of your home and are considered differently in NY law. In your house you have no duty to retreat. To use lethal force you must believe your life or others in the house is in imminent danger. There is no requirement that you see a weapon or even that they have one. You just need to believe it as any reasonable person would. The burden is not on you to prove it was justifiable. It is on the persecution to prove you weren't. A criminal breaking in could say 'you are dead'. That would be enough for a reasonable person to believe they meant it. Out side you do have a duty to retreat with a few exceptions. Witnessing a rape is one. You can justifiably react and engage the rapist and again. No warning is required

  14. definitely not the lightest loads for the 06. I am comparing the usual loads used on deer for each. In this conversation would it be more accurate to compare a 65 grain in 243 and a 220 in the 06? no way. Even if you bumped the 06 to 165 the trajectory is not that different at our normal hunting distance. And regardless of the decision made on the caliber the heavier bullet is affected the least by the wind.
