Not a single court has heard a single case. They didn't rule against the claims. They chose not to hear them. That doesn't mean a court will always be able to refuse to hear a case. One will have to, sooner or later.

Oh yeah. I once hunted along the Cold River on horse back, miles back in the woods from Tupper Lake in the middle of October. There were lots of big grouse all over that area, and they had no fear of humans. Getting a limit was easy and they were all big birds. Gotta get back up there again soon.
