Any lawyers/prosecutors/LEOs out there want to weigh in on this...

If the new law does not go into effect until March 1, does that mean one still has until that time to purchase a currently legal weapon and have it grandfathered in?

I asked this on another thread, but it is going to get buried and I would love if someone with knowledge of the subject could provide some insight.

I saw the article. But the news has no idea what they are talking about when it comes to anything most of the time. Especially when it comes to guns. So i wouldnt take their word on it.

But i should note that different parts of this law take effect at different times. Some are effective immediately. Some 60 days, some 90 days and some a year. But the important "Assault Weapon" one is effective immediately.

I should have included this link in the original post. Basically, if the law were in effect today, every LEO would be committing multiple violations of it.

Yes, there is misinformation out there. The article is false. It is going around like crazy. The law that exempts LEO's is still on the books. This new law is added to the law as an amendment.

I also saw march somewhere and was wondering the same thing. There also seems to be a loophole where you could purchase a used AR at a gunshow out of state (with no background check) and them bring it back and register it within the one year. No way to disprove ownership.

Yeah, I knew about that, but I was actually hoping there was a legal way. I had finally settled in on a DPMS Prairie Panther as my predator gun, then they passed this law before I could buy one.

The way I see it, the "Assault Weapon" one is pretty much unenforceable until the one year deadline for pre-ban owner's to register theirs is here. How else can it be determined if you're a pre-ban owner who has yet to register your gun or a guy who has an illegally purchased and possessed one? or is the presumption going to be that if the gun is unregistered it's illegal and it's up to you to prove otherwise afterwards?

I'm guessing they could check the date of the background check for purchase, unless you were to buy it as a private sale.

Could you purchase a lower, legally now, and then build a gun that would be considered illegal as long as you register it within a year? Bah, I'm going to have to hire an attorney to figure this out.

This is exactly what im trying to figure out too right now. From what im reading, their is nothing barring it. But the stores are a little lost, and will refuse to sell it until it is figured out.

As for the question about checking background checks. The ATF does not keep any records of background checks. But by law the dealer had to keep the record and it had to be made available to the ATF if they ever showed up( Bloomberg forced Long Island shops to show them this, and they are now suing). But the new NYS law allows police officers to look at these records.

Everything I have read shows that the ban on ar's is immediate and the mag restriction goes into effect April 15th.

As for the law affecting law enforcement, US Bill HR218 signed by President Bush protects all law enforcement and qualified retired law enforcement from any state laws. Federal protections supersede state law. They are allowed to carry in any state as long as their qualifications are up to date.

Finally, don't expect the crime rate to drop in any major city in NY. The cities with the highest homicide rates are always linked to economic conditions and not the gun laws in that specific state. Oakland California and Camden NJ consistently rank number 1 and number 2 in the country for the most homicides. NJ and CA have the strictest gun laws in the country.

I would expect the actual crime rate will increase. However, the media and the government will decrease the reporting of gun crimes to project the perception that the new gun laws are working.

The major skewing and doctoring of the statistics will begin one year from now as we approach the elections.

Expect to hear that the new laws have reduced gun crimes by close to 50% in all new york cities.

what if you had an ar15 disassembled, then it lacks any of the attachment BS in this law

Don't think that would quite cut it, probably no different than a dealer not selling an assembled gun, but trying to get around it by selling all the parts to build one.....if you already have one, why not just register it instead of making it into a box of parts?
