Did you address mutual retrieval rights? Hopefully, you can come to a mutually agreeable understanding as to hunting/shooting onto each other's land as well as retrieval rights. Whether or not he honors the agreement is another issue. What if you put a trail cam on your property, maybe 10 yards in from the property line, looking at his tree stand? Al Bundy Posted November 11, 2019 Author Share Posted November 11, 2019 Yes retrieval came up. He said no problem for me to go retrieve without permission. He also moved a tree stand that was about thirty yards from my stand. It’s now clearly on his land and facing down into his land. I look at this as a very neighborly and thoughtful action. He seems to want to do things right. I am thinking the trail cam idea might be a good idea. He knew where survey posts were and his stand placement was well thought out according to the boundaries. I don’t know when the adjacent land was surveyed but where I hunt has been in the family since the early 50’s and has not been surveyed since. Iron rods with orange caps are visible though. So... I need to welcome this new neighbor and get used to the fact he’s the first one to hunt there since at least early 70’s, likely even before. 1 Quote Link to comment Share on other sites More sharing options...
Don_C Posted November 11, 2019 Share Posted November 11, 2019 Tough situation all around, but at least it sounds like the guy is reasonable. We have a guy that has box blinds along one of our property lines, on a logging road (ours). The guy told me at our first meeting that he has been shooting over the line for 40 years and isn't going to stop now then complained about another neighbor putting a stand too close to his property line! (LOL!). We put posted signs up smack dab in front of each box blind to reinforce the point. The local ECO officer told me to call immediately when they shoot a deer across the line, but we decided not to make a big issue out of it unless there are some other problems that arise. We walk right by their stands on the way in and out, we will ride the 4 wheelers by them pulling deer out and we park within 150 yards of one of the stands. I'm hoping our commotion will deter their activity somewhat. This is our first year on this property, but from what we can tell, the deer movement puts nearly all of the deer in front of our stands long before they ever reach the property line. You don't want a simple misunderstanding to create a much worse issue with regards to harassment, recovery rights etc. However if he's not open to the friendly have a chat approach he should be informed that he CANNOT shoot onto your property. Maybe they were put up so the adjoining landowners could use them to hunt their own land from those stands and setting them up for a trespass ticket.
