Screwed!

So, here it is, October 2nd, and I still haven't been able to even get an arrow rest, or sight for my bow. Why? Because my car got impounded because of a screw up on the part of the insurance company we signed up to in June.

On June 4, we spoke to an agent of this company, and he quoted us a fantastic price of $82 a month. However, we would have to pay 2 months up front, for the first, and second month. So, we gave them the $164.

Unfortunately, as of July 24, they cancelled our policy, claiming we didn't pay for July (note that we paid for the first two months up front). They didn't send us anything to notify us that they had done this. We were also NOT sent any payment plan. We figured we were good until Aug. 4.

When it got past Aug. 4, and we didn't hear anything, my wife called them to ask where our bill was. They said not to worry, that everything was fine, and that a bill would be sent, when payment was due. Note, as to how my wife called them after the cancellation (which we weren't aware of), and they still didn't tell us anything. Needless to say, we didn't find out until September, when the DMV sent us a notice saying that our insurance had "lapsed" on July 24. My wife went and got insurance coverage right away. So, we didn't hear anything. The other night, I get pulled over on my way to work. The cop says that my registration is suspended. I honestly didn't know that. The end result: car impounded, ticket for no insurance (it is insured, he gave me a ticket for no insurance anyway, even though I provided the proof it was insured), and a ticket for operation of a motor vehicle with a suspended registration.

So, after this fiasco, I raise hell with the Regional Manager. At first, he denies that we paid for two months up front. Finally, he says something to the effect that it was an "after hours" quote that we received, and claimed that somehow that made a difference. I had spoken to a REAL person, named Chris, who gave us this quote. I told him, that when it was, was irrelevant-a quote is a quote, and that's what we paid the two moths on. He claimed their was no documentation to support this claim. However, knowing that they record the phone calls, I asked him if they archive the recorded conversations for their own protection. I told him to pull up the conversation I had with Chris, to see if I was lying.

All of a sudden, things changed. He told me that all he could do, was extend the coverage to Aug. 4, which as I stated earlier, was when we should have made our next payment. Apparently, he was full of it, and didn't want to admit that they made a serious mistake. Now, I have a car in impoundment that I can't afford to get out, and I have to rent a car to get to work, which I can't afford. Talk about screwed!

Lets see...go to court ...give judge ear full about officer and the insurance problem...copy of all cost pertaining to the insurance companies screw up...ie impound... and court fees and rental...and submit them with a letter saying they need to be reimbursed or you'll see them in court...I'm assuming you didn't give them 164.00 cash?...with no receipt Oh...and now check your credit rating...they may have screwed you up there as well

I'm trying, Elmo. They finally, after me doing battle with them, submitted verification that I was covered until Aug. 4th, to the DMV. I still have to get my car out of impoundment, and I'll be damned if I'm going to pay for it, when I did nothing wrong. I'm wondering if I should sue for the hell we've been put through.

I know time can be something we all are lacking but I would file in small claims court. my have to take up a hobby just to bust their stones!!! They might toss you the cash just not to have to deal with it. Hope it works out for you and Grow had a good point. Check your credit rating to make sure they dind't hose you there too.

Thanks, CulverCreek. I'm not sue happy, but this really screwed up our lives.

That's good news, 13B!

Not only should you not have to pay to get your car out of impoundment but they should reimburse you the cost of you renting a car this whole time!

absolutely!! they need to make right on this for you. im sure this will all work out for you, its a shame you have to deal with this

I appreciate the support on this, guys. If I had screwed it up, I would just suck up the punishment. I didn't, however, and it's driving me and my wife nuts. What are the odds the insurance company is going to bail my car out? Probably nil, and none, without me having to give them a fight.

Hey "Grow" why should the judge get an earfull about the officer doing his job???

To me, this is not about the officer. My only pet peeve about the officer, is that I presented proof of insurance, and he still gave me a ticket for uninsured vehicle. On another note, however, these cops consistently run red lights, talk on cell phones while driving, speed, and quite frankly, I know guys on the force that had prior felony convictions like assault. That's not to say all cops are bad, but there are certainly a few bad apples on the forces around here!

I'll tell you why...NYS has set it up so the decisions of fines are taken out of the judges hands...point..... he showed proof of insurance..... none of the horse hockey was his fault but the officer ticketed him any ways...So now he has to go into court have the judge say I see your proof but NYS requires me to charge you a court fee for getting the ticket in the first place...which is bull

I got a ticket for my registration lapsing 3days...long story short I was stopped...actually I stopped and waited for the trooper to turn around...When asked if I knew why I was stopped I said....I was 5 miles an hour over speed limit ...going to pick kids up from school...noooo registration laps..OK...ticket...

Went to court...told judge entire story...you all know I like details...and he Gets really pizzed...not at me...but the trooper...for not giving me a warning and time to get registration taken care of...Then he apologized to me in open court because...he had to charge me the NYS mandated fees because the ticket had been issued..

Should have rephrased ear full...but letting the judge know ...they will let the officers know what they think....had same thing happen with a bad tail light...judge was ticked that I wasn't just told and let go...I had to have a mechanic certify a light bulb was changed.....But that was probably my fault...When stopped ..again taking kids to a school dance.... Cop stopped us right in front of school...asked me if I knew my tail light was out?...I found it to be..a stupid question...so said...no ..it wasn't out the last time I was running behind the car while driving...needless to say.....

And your story about the registation lapse i agree you may not even know that it happened and you should def. blame the insurance companies for that mix up. 13BVET it sounds like you got a very fly by night insurance company that really did screw you. The original insurance company screwed up. The insurance we have now, was started on Sept. 11, so there was no way in hell that it could not have been valid. That was started immediately upon finding out (finally), that there was an insurance "lapse" claimed.

FYI, the previous insurance company sent verification to the DMV yesterday, proving, that, in fact, we were covered until. Aug. 4, instead of July 24, when they claimed it lapsed. One of their employees screwed up big time. If the insurance cards serve no purpose (or don't prove that you have insurance), then why does the state require you to have them? There was also an 800 number on the back of the cards, which he could just as easily have called, since they're there 24 hours a day.

I do agree that the insurance company we had was screwed up. However, it was NOT a "fly by night" insurance company, but a very well known national company.
