Rebuilding your life from scratch is very tedious and time consuming.

It breaks my heart not being able to hunt but one has to set their priorities.

Steve are you still battling with the insurance company over your house after all this time ? WTF !

After 2 1/2 years the battle is over with them and they have won. We ended up loosing about $51,000. If we didn't accept their last offer we were looking at another two to three years of litigation and thousands of dollars out of our pocket and a good chance of not not gaining a thing.

We are still fighting to get some legislation passed that would give policy holders some rights but that has been a uphill battle also.

There are bills written to address these issues that have been sitting in the Assembly and the Senate for two years and trying to get hem advanced is like pulling teeth.

The politics in this state suck and it is only getting worse.

I had a fire little under two years ago. I believe that is what happened to you? Fortunately State Farm Insurance was wonderful. Structure wise they went above and beyond. Personal property loss was in my hands and I couldn't remember all the stuff I had. Big ticket items were replaced. I had actual replacement value. That was huge on the coverage. I tell people take a video or pictures of all your stuff. You will forget so much and not get reimbursed.  My claim stayed open for two years and is just about to close. I'm sorry you are going through this, emotionally it can wreck you and to have the insurance company give you problems is horrible.

Suffering a catastrophic loss; desivating. Dealing with a business that capitalizes on people's misfortunes  for profit using zopholes as an excuse not to compensate, inexcusable.

I always say, when the going gets tough, hunt. Great stress reliever.  Great confidence builder. Nice pick me up.

 Ironic you should mention State Farm. It just so happens there are a bunch of property owners in Farmington that are complaining about All-State. It has been reported on the news and Senator Pamela Helming has been involved.

We fought for 18 months(using an attorney)  just to get the amount we were entitled to for the "structure" and another 7 months in court for the contents. You are correct  on the full replacement value coverage and you can't have enough documentation to support your contents value.

It is not just us. I couldn't begin to tell you how many horrible insurance stories we have heard since our incident.

We have been trying our best along with others to advance Senate bill S1797 & Assembly bill A7139. They have been sitting for over two years. New York is one of three states in the country that does not have "unfair claim settlement practice" laws that will help policy holders.

Steve is that who you had for insurance was Allstate ?   I had Allstate Ins on 6 properties of mine which included my house, plus our cars . I own 16 real estate properties in all. Allstate only has 2 of them now . A garden style condo and a townhouse condo with a garage under which will be switched to another company shortly. I found out recently that Allstate silently eliminated a loss of income clause on rental properties . When I discovered that I called the agent and asked where the clause is . He said the income loss would now come out of the rebuilding funds. So if I want that loss covered I have to increase the rebuilding cost policy.  I just got a quote from another company for those units that covers 60K higher rebuilding costs Plus a loss of income allowance of 110K for one unit and 135K for the other . The new company is $125 for one and $135 LESS than Allstate's less coverage policies.  Pays to shop around ! 

 Another property I took away from them when I started switching insurance companies is an old farmhouse with a detached good size barn . At the time they told me this was the only policy offered for that type of property. Its called a depreciative policy . So even though I was insured for 600K , they could at their discretion if I had a claim , they had a right to age the property and only pay what the old structure was worth. I didn't know that. The Allstate agent never brought that to my attention. When I was shopping prices a different agent saw the policy and explained that this was junk . Allstate could legally get away with paying me 200k even though I had a 600K policy . Wow was I pissed. But that was the only policy offered and was told that all insurance Co's had the same for older structures . Not true. I now have a 675K policy of full replacement cost plus loss of income clause of 135K built in . This is a totally remodeled farmhouse thats a rental property. The kicker is my new policy is just 135 dollars more for triple the coverage if you figure in Allstate's depreciation policy.    Screw Them !

No we didn't have Allstate. What we have found out is that it doesn't matter who the insurance company is.

The important thing every one needs to remember is they all operate under the same principle which is making a profit and maintaining profit margins.

The adjusters can make or break a claim and typically the the senior adjuster sitting in the office is the one that calls the shots on how the claim is processed. The first one that visits to witness the damage is only a flunky that is there to gather information for the one that sits in the office.

The one sitting in the office is the one who's job it is to make sure the company pays out the least amount as possible.

Your insurance agent can be a big help structuring the policy, but remember they survive by selling insurance and may not be forthright or even be aware of conditions in the policy that could work against you in the event of a claim.

Steve I feel your pain. I'm sure what you are describing is horrific. Being I went through this also, not to the extent you did, I just want to share how it went for me. Again Insurance agent was State Farm. There on call agent for fire called me and said go get a hotel, 3 meals a day and don't worry we will cover it. I told him I was ok in the house. The adjuster showed up the next day at 9 am. We spent 15 minutes together and I left for work. He had the whole thing worked out with claim by 3 pm. It was actually a document sent to me. Every spelled out correctly and a value on the claim. I was amazed. Don't ever try to cheat on square footage, they had satelight pictures of my place and and square footage. You must be dealing with a pretty crappy company. Sorry for that.
