Tubular magazines & safe act ?

  A friend of mine wanted to buy his son a Henry rifle with a tubular magazine for X-mas  . He went to a gun shop & was told because it held more than 10 rounds (14-15) they could not sell it to him. I believe it was 22 cal. & would the cal. matter?   I may be wrong,  but I was under the impression that only auto loaders had to hold less than 10 rounds, not lever actions with tubular mags. ?? Of course this is in NY state!

3. Certain Tubular Devices / Curios and Relic Exemptions

Possession of an ammunition feeding device that has a capacity of more than 10 rounds is still legal under the Safe Act if:

a. It is an attached tubular device designed to accept, and capable of operating only with

.22 caliber rimfire ammunition; or,

 

Tell your friend to go somewhere else and buy/enjoy the new gun. 

Lever action has nothing to do with new regulations.

And even semi-auto .22s with tube magazine are OK (Marlin model 60, etc)

As we all can see by this thread the safe act is a disaster.

As it was intended to be. In fact most gun control laws are designed for maximum confusion to discourage firearms and accessories purchases. It is working exactly as intended as shown by this response by the sales clerk.
