ONEIDA COUNTY, N.Y. -- An Oneida County man was accused of attempted murder after shooting at three people. State Police say the victims went to the home of Albert Nellenbach, 35, on Webster Hill Road in the town of Ava around 6 a.m. Sunday.

Jesse Wilcox, 31, Christy Wilcox, 26, and Lester Platt, 50, were looking for Jesse's brother, Jared Platt. According to investigators, they noticed Nellenbach in a sleeping bag near the tree line. As they approached, Nellenbach allegedly jumped up and started shooting a 22 caliber rifle at them.

Jesse Wilcox was hit in the ear, elbow and back. He was taken to Upstate University Hospital, where he is in stable condition.

Nellenbach is now charged with attempted murder and first degree assault. He was arraigned and sent to the Oneida County Jail on $50,000 bail.

I don't know anything other than what I saw in this artical, but it sounds like the guy was maybe camping out??

Then he wakes up to see 3 people coming his way at 6am. He shoots and is now in jail for attempted murder.

By the sounds of the story they said they went looking for this guys brother. So one could assume that he knew there were going to be problems.

Now what if that were a troopers house and they walked up and the trooper shot would he be in jail right now?? I think he all know the answer to that!!

Anyone have some thoughts on this???

Not necessarily like I said all I know is what i've seen in the artical, but it's pretty safe to assume they were not going there for morning coffee.

The guy was sleeping and he woke up and saw 3 headed for him at his or his brothers home. I'm by no means saying he should have stood up and just started firing but we weren't there so who knows is there were words exchanged.

I was just wondering what other people thought not making him sound in innocent nor guilty.

The title in your first post is not neutral. You make it should like the shooter is being prosecuted for actions you see as a valid response to a situation.

This is what you get when you defend yourself in NYS.

"Defending" yourself implies you had cause. Opening fire on 3 people walking towards you (reportedly) without saying a word, is, for lack of better words, batshit crazy.

EDIT: OK, just read your post above this one. If that isn't how you meant it, sorry for the misunderstanding.

Lets see...never believe what you read....there's always two sides to a story... when you ASS U ME....so don't know enough to form an opinion one way or another...but.. :biggrin: ...If the guy was out along his tree line...not in the house...he knew something was up and was out there for a reason ..what time will tell.....

I see nothing in the article that would justify the use of deadly force.

Trigger happy nimrods that open fire without justification are as much of a threat to our liberties as the anti gunners who want to strip us of our rights under the Second Amendment.

OK, if that's not the way you meant it to be interpreted, so be it. But, do you see how the title of the thread would lead someone to believe that you have already formed your opinion? Plus, the 'Armed With Pride, NRA logo' and the 'Hunt or be Hunted' screen name seem to imply that you might lean in this general direction.

That would be ashame to be honest with you that a bunch of adults would even go back and forth for 40 pages.

If it was up to me I would have just edited the tittle, or deleted the hole thread but it's allright no ones perfect!!

I can agree I should have worded things a bit better, and we can all move on to a new thread about a monster buck or something!!

This isn't directly at you but rather, I'm making a general statement to many people I talk to and see in public.

If it looks like crap, if it smells like crap, odds are it's crap. So many young kids today dress with their pants sagged down to their knees, hang out in corners, and tattoo themselves up and down and then they complain that cops stop and question them. Really? It's funny because I wear a shirt and tie, my tattoos are not visible at all, and I sit at a coffee shop reading a book and crazy enough...the cops never harrass me. Coincidence?

The point I'm trying to make is that whatever message you want to send forth, be prepared for the response. If you want to pierce a horse shoe through your nose then expect to be stared at. If that's your thing, then cool. What evers. Just don't go around complaining about people staring at you.

Again, Bill. This isn't directly towards you, it's just me venting in general and that comment reminded me of this.

The title states he was defending himself, you wrote the title and thier for it is believed that is your opinion. Next time write Shooting, was this self defense or not? Justified? What if it was a cop? I understand that was not your intent so no need to reiterate...

In so far as the guy knowing trouble was coming, well aparently he expected it... Otherwise he would have been sleeping in his house... Wow I hope I never have to camp outside my house for a idiot brother... I have at least one(idiot brother), the others are OK... More than likely drugs or money are involved and the brother in question is probably in trouble with both... Hope the victims are ok...

I have two idiot brothers. I'm not a home run either by any means. But I'm at least a double if not a triple. By baseball standards (going 1 for 3 with an double) my parents did okay.
