I dont see a problem as long as you have permission and arent shooting out of your truck or across a road or shooting them at night. Spot and stalk hunting can be great fun.

20ftupatree ---- What you are doing to Legal . I don't see a problem with that . I have done that with woodchucks in farmers fields . You can shoot from very close to a road but not across the road .

As long as you are across a guard rail, fence or beyond the mowed section of the road. Thats where the wardens around here get ya.

I know you can't shoot across the road, but is there a legal limit as to how far off the road you have to be when you shoot? Do you have to be off the public highway right-of-way and onto private land? I never shot that close to a road to have to worry about it, but now that the discussion has come up, I'm curious.

Doc, I believe it covers this a little in the frequently asked questions of the syllabus. It says there is no certain amount you have to be as long as its beyond guardrail, fence, or mowed section because it is considered the maintain part of the highway.

Correct, multiple DEC officers have told me the same thing, as long as you are off of the maintained part of the highway.

I was always under the assumption that the seasonal roads that are not maintained year around was ok to shoot from. Found out after reading the syllabus that I am wrong. They are still considered a public highway.

All it says in the Regs Booklet is , "It is illegal to shoot across a highway " .

I know we have a lot of dirt roads that have no guard rails, mowing or fences so I guess you could be standing just off the gravel and legally shoot. That's surprising, but if that's what it says, then that's what it says.

I am from pennsylvania and a college student in new york. I was wondering if anyone can inform me on the days you can spot light. I know you have to be 500 feet from a house. I was wondering if it is legal to spotlight during season, as in P.A. it is illegal.
