Is it wise to say someone is guilty of war crimes and should stand trial for them, if that individual controls a very large nuclear Arsenal ? 
 

I can’t see what could be possibly be gained by such a statement, but it is pretty simple to see what could be lost.

Civilians with arms that fight back against an army/soldier shift to being combatants and are fair game.  These are the rules of engagement and the US followed this in Iraq.  Killing these "civilians" is not a war crime as they are combatants.
