I am from the same place a ncountry.  This did take place on 37 in the area he said.  That being said, I know this young lady.  she has an associates degree  in criminal justice and graduated Saturday with a bachelors in police administration or something like that.  She failed the physical part of the test for the border patrol 2 weeks ago.  She is a distant friend of my daughters.  She has been fired from at least three jobs for her attitude.  She went there looking for a fight with her chip on her shoulder. She now may be facing federal charges for a few things.  She wanted her 15 minutes of fame and has gotten it.  Now it will cost her dearly in the end.  Check out her facebook page if you want to see the real her. 

It was pretty obvious to me what she was trying to do. Just a rotten little snot trying to provoke and catch something on her little spy cam, which she conveniently didn't have running during the initial stop. She got exactly what she wanted…her little burst of fame. It worked. So don't feel sorry for her.

She is a young girl, if he isn't good enough to restrain her without the use of a tazer he doesn't deserve his job... I thought when we became adults we had certain freedoms... Imho, Too many people say just shut up an do what you are told... We are "free" Americans , not sheep... Although we are rapidly becoming used to becoming subservient.

tazers actually prevent further injury in most cases......the other option for someone who is resisting arrest might be a flashlight applied to the head a few times.......take ur pick.

Actually made me lol.. I am sure a tazer probably doesn't leave much of a lasting injury or mark... If you are comfortable living in a society that is slowly eroding our basic rights. That is fine.. I'm not..

We shouldn't have to make excuses.. if she was just more polite or if you don't have anything to hide, it's easy just go along with the flow..

Unfortunately I think those that think like me are rapidly disappearing. Society would rather be told what to do then take any self responsibility.

I actually did not watch the whole video....most things like this are edited or only contain footage that the poster wants you to see, so I choose not to get caught up in such stuff..........but either way, if someone resists arrest, there are several ways to take someone into custody...some more pleasant than others.

Oh no, I think she went about it all wrong...like I said her manners and attitude suck. Still not a reason to get tazered. Hell if they talked to me before I had my coffee in the am I would be tazered daily... I have been bitching and voting accordingly ever since our response to 9/11. I am afraid to see what it will be like in another generation or 2.

If you feel that you are being wronged, at a check point or a traffic stop or at any other police encounter there are means to deal with it. File a compliant, record it , sue them… what ever. But if you think standing there playing F-U! with the police is the right way to handle it…..Good luck.  How many people here have been stopped for a reason that they think they shouldn't have been stopped for? ….How many have played F-U! with the cops to the point they ended  up getting tasked?? Lets get a list going. I'll start…Not me.

Once...and I was in the wrong but sorta for a reason..

Some place in Irondequoit NY I'm 18 and I have two young step sisters with me...I get lost coming back from a DR. appt....I mean crazy lost... Left Westfall and ended up headed toward Buffalo...than back to the zoo then over to Bushnell Basin...the whole time little one in back seat crying and carrying on she has a dentist appt in Avon..4 lanes...hey I'm from the country...4 lanes meant 55mph...I'm not looking at speed signs I'm trying to find anything that says South!...So he pulls me over and asks...God I JUST LOVE THESE QUESTIONS!!! Do you know why I pulled you over?...NO! if  did I wouldn't have been doing what ever it was to get pulled over..Do you know how fast you were going? NO!  I'll I know is I've been lost in this city for 2 hrs with a screaming kid in my back seat and no clue how the hell to get out of here...56 in a 35...WHAT!!! it's 4 freaking lanes where I live that's the express way! PLEASE JUST GIVE ME A TICKET AND GET ME OUT OF HERE!!!...

So he did ....went to court ...pleaded not guilty...told judge what happened..... judge ask officer and he confirmed...failure to yield right of way and a 10.00 fine...It helped I was young thin and a looker back then, wearing a very nice dress and spike heels.

 

PS...Now I'd have to rely on the old confused lady ....

Thanks had long dark hair too...remember  asking an officer about what to do and where to go  in the parking lot...he escorted me to the court room and told me he'd be right back completely ignoring the guy friend I took with me to drive home that night...a few minutes later he came and took me to the DA's office where I told the DA what happened and he asked officer...then sent me back to court...OMG the judge was horrible I was like one of the last cases and sweating bullets...lots of ppl want to jail that night and he ripped many a new ones for little stuff....( a few weeks late the D&C did a piece on "the hanging judge of Irondequoit")...I think back to how lucky I was...anyways he calls me up and says.... I see you plead not guilty..Yes sir...I saw it coming and he started WELL!.....just then, he was handed a note... Asked to speak to the officer asked me what happened and read what the DA had written...The good ole days....heeheehee

Feeling wronged and being forced to endure illegal procedures are two entirely different propositions. Yes, there are ways to get through them with minimal fuss, and hopefully one will not get tazed. But the fact is these 'encounters' have no place in our society and are contrary to law. I hope people don't focus on the bad behavior of the individual involved. These checkpoints are illegal, pure and simple.

 

I could post several cases of folks who handled themselves quietly, and with dignity, but who still ended up on the wrong end of a K9 or a tazer for simply expressing their rights.

Not disagreeing with the above point - I agree. Still wonder about something:

When the government makes laws/rules/policies and these are put into practice... and the courts uphold their "legality"...

At what point do they go from illegal to legal? In theory or in practice. You could argue that the BP stops have become de-facto legal because the government is conducting them and no one has been able to stop them.

2A says "shall not be infringed." Yet, there are a myriad of laws which clearly infringe. The courts still rule in favor of the infringing laws, and the infringement continues.

We do something "wrong" and end up in jail. Government does something wrong and the courts back them up (after dragging the argument out for years in the system). I think the problem is collusion... the checks and balances system is broken.

Unless you amend the various constitutional rights that they conflict with, they never become legal.

There is no such thing as 'setting a precedent' in these matters. The courts get lazy tho, or rather, they deliberately obfuscate the bigger picture and allow this criminality to continue.

 

The base-line problem is that people don't care enough, or are too scared to stand up for the constant and deliberate infringement of rights. General ignorance obviously plays a large role also.

The BP checkpoints are legal. Thousands upon thousands of people cross them every day without incident. It was looked at by the SCOTUS back in the 70's I believe.

The checkpoint in question was carried out by BP but not at the border and not for anyone crossing as far as I know.

 

Illegal and unnecessary in other words. In fact given the state of border security ( we don't have any), these events become even more insulting. When you cross an actual border, there is an expectation of consent in terms of being questioned etc. This is not what happens at checkpoints set-up on roads that are no where near the border or indeed on a crossing point of any description.

 

It doesn't matter who looked at them or when. They are infringing on more than one of our rights. Scotus has lost the plot on more than one legal issue in my lifetime.

There are 100's of miles of border where one can simply walk or boat across. Does anyone think that maybe the majority of smugglers maybe don't risk crossing at the border stations? It only makes sense that we would use methods making it riskier to walk/boat across at a distance where they have picked up vehicles to continue on. That is why the courts have deemed the BP checkpoints reasonable and legal. Stop them and you may as well just do away with the border stations as well.

Setting up checkpoints 50+ miles from any of these accessible border crossing areas makes no sense. I am sure there are roads that a closer to said crossing points. Smugglers are going to need road infrastructure as soon as possible. And if indeed they are crossing over through the barren wilderness, it makes even less sense to be road blocking. A helicopter sounds like a better bet.

 

There is a reason why civilian groups have taken to policing our borders. The authorities have dropped the ball on this problem in a very large way. And now we have ISIS in 49 of the 50 states according to the director of the FBI. BP is a waste of tax dollars at this point.

We have ISIS in 49 of 50 states due to the internet. they do not have to step foot on this soil other than a few top trainers. The recruiting is being done from with in the citizen ship..BTW did anyone take a second glance at the recent prison riot? See here's where it is seriously scary...Americans have minute memories and or an inability to see the larger picture...they completely forgot why Nam was a failure and would be from the start...they were clueless as to the  911 prep. taking place on our soil ...not over seas... With 20/20 hind sight they are still seeing and either down playing or ignoring  ISIS preparations happening now...ISIS does not care what color one is when they recruit...they'll take care of any "issues" they may have after they have used all the ppl with axes to grind , when they achieve their goals...See one does not need to be a brilliant strategist to see how to achieve their goal...they just need to know human nature... This country had it's "glory days" then became complacent and weak minded.
