Those silly landlords .....

First off I know there are as many bad tenants as landlords, I’ve delt with 100’s of both , but most of my difficulty at work comes from the landlord/ owner side. But I digress....

Daughter one gives written notice of not renewing and follows up with a phone call, they hold back half of security deposit for, improper notice. Since letter and check came to our house , I called landlord , and explained she gave proper notice and in fact I read it as she wrote it on our kitchen counter. She just says well they lost half a months rent trying to rerent it, I remind her that she gave proper notice and I’ve aways had a good relationship with her husband, which she doesn’t get, so I tell her I inspect their two buildings .... she asks for a couple days to discuss with said husband , well 9 days passed no check so daughter is filling in small claims Monday.

Number two calls last night from Buffalo, landlord was to make repairs yesterday . Well a roommate came home to find a woman’s designer handbag and coat in kitchen along with a pair of woman’s boots, then she sees her bedroom door is closed.... she tries to open it but landlord is on  other side holding it closed..... he’s inside with some woman doing you know what. He tries to say she helps with drywall LOL !  

I ask number two if landlord is married ? “ yes.” , “ well looks like your rent is going to get cut in half !”

He  probably had to pay to fix the place up .

That is why he 

Kept it . Yea if your the  the tenant and you give notice but leave a dead cat in the fridgerator and a dump on the floor .

Guess what your probably not getting all your security deposit back :)

That's not the reason the lady gave as to why they were keeping half of the security deposit. And if it were, there are procedures to document and communicate that to the tenant. There is nothing indicated in the OP to sugget that the condition of the apartment was an issue. Your "probably . . ." and "if . . ." statements are purely speculation in this particularly situation, not that things like that never happen.

And what reason did she give ?

What do you think a security deposit is for . Damages or she broke  the lease agreement in some way .

Did she have a lease? If yes ,if she left early she loses the  security deposit  automatically and even could be sued for all the months left on that contract.

Gross that’s getto nasty. Some people have no respect for themselves or others. Get that kid out of there!!!!

Storm did you read my post ? Reason stated in the letter she received was “ improper notice “ not damage . Our conversations with her reinforced that claim . 

Actually this landlord doesn’t do a written walk through inspection prior to and after move out, which would be necessary to prove damages , which isn’t the claim but I added that for your own information on how things work legal wise .

Its fairly common for scummy  landlords to try and keep part or all of S.D. Of young folks as they think they won’t pursue it. It’s almost SOP in collage towns as the kids move away after .

Any apartment my kids rent are improved, as first thing I do is add smoke and CO det. Reinforce door jam and lock area, get stuck windows working again, fixed a drain in the tub and so on .we did ask the guy to repair wall damage and clean stove on move in day ,  pics attached.

See I document everything I feel is or MAY become an issue at some point .

yeah man people will try to get over if they could like you i have a hundred horror stories both with tenants and land lords.I work for the gas co. in the city and i seen land lords take avantage of tenants all the time. Really who looks in the basement and see what their gas and electric line goes to what meter. I was working on a gas line outside the house so i went to light them back up and the hot water heater wouldnt lite now the tenant wasnt home so i left the meter off .It drove me crazy then i knew the landlord put the water heater on the tenants meter .Another time as a matter of fact a more than a few times the tenant comes to me and says i was on vacation and got a$ 300 gas bill and i only have a stove all i tell them is talk to your landlord . believe me i seen it all

Ya, that girls Mom is super pi$$ed off about that .

He’s going to receive a certified letter , noting what was observed alone with what  took place and what will be expected , notice wise  before entering premises in the future . Which BTW now has a “ nanny cam “

On the bottom of the letter my wife’s nephew ( attorney ) will be CC in along with the Buffalo Housing council , just in case later on he tries to get “cute .”

Myself I would have quietly taken boots, coat and purse and left .......

Tommy thanks ! I work with the gas and electric guys all the time Red tagging things. I love you guys as your knowledge in that field exceeds mine and try to learn from you guys .

when we go for fumes or co the first question I ask the tenant is if any work was down recently, and if the landlord or his buddy did it as they’re  mostly hacks .

So there you go it is probably In the lease she needs to give so much time  . 

And unless you are renting for almost nothing up there in a bad part of town  why would you move into a place that was not in good condition in the first place? 

Tell that to a  judge you will probably get a laugh out of him unless this guy has a bad reputation with lots of violations on his RECORD you daughter is going to lose. 

I comes down to credibility sometimes college age kids aren't exactly known to be the most responsible people. 

Think animal house the movie .

Party's beer You know what I'm saying :)

Not that I know you or your daughter .

But it is what it is .

If the guy has had know  problems before and you have know proof and he does .

Who side you think the judge going to believe.

Unless you have a really good proof written proof i would tell your daughter just to forget about it it's not worth wasting the time in court over it .

I am dealing with one now and hoping to heck get out soon.only time they do anything is when uve got money for em.they show up to pick it up then leave.it is a roof over our heads and heat so I can't complain too much

Or mail him a certified letter

Explain why you think your right . And add something like 

But instead of us arguing in court about it wasting time just give me half back .

Maybe he will agree. 

You got to ask your self is it really worth the time and aggravation to go to court over it ?

That's all sorts of messed up! On both of the issues. I hope this gets worked out and both of those "landlords" get some additional fines. Slobs!

Don't know what exactly that lady  problem was but shifty tenats often used that type of excuse to not pay there utility bill , utilitys company will send out someone to check most times  tenate just a  shift trying  to get out of a bill  lots of  them don't even put there name on the mailboxes so they can't be tracked down easily by credit agencies :)  

Then you get the pack rats that you need to use a shovel to move the crap out of the way to get in the apartment :)

But it don't matter because everyone hates the landlord. :)

you are so right i seen it too with tenants .like i said people given the opportunity will try and get over. My nieghbor rented to a guy and his daughter and had nothing but problems finally got the marshalls and got the guy out and he rented to my daughter and never had a problem .He rented up stairs to section 8 which is welfare and shes a slick one you dont put up heat i sue,you dont shovel and salt i fall  i sue, they know every trick in the book .He thought cause its the state you are gaurenteed  the rent on the first you are but it comes with headaches. Watch pacific heights with matthew modine and  Micheal keaton  in it .

Renting sucks. I’m glad those days are over for us. And I only did it for a couple years before buying my house at 25. Our last rental was a duplex. Owner lived on the opposite side. They were nice people and all but I’m 99.9% sure he was ripping me off on electric. We always had some crazy high bills, I’m talking up over $1000 in the winter. I asked him probably 30 times if he was positive the electric was setup correctly. He always said ya it’s fine. We stayed there for one year before giving our notice.
My first rental was another duplex and the oil furnace would emit a crazy amount of burnt oil smell into the house when it fired up. The furnace was so old my FIL who owns a oil company had no way of even getting parts for it. The landlord was again a nice guy but had zero intentions of fixing or replacing it. He did get some electric problems sorted out for us though when we found half the outlets in the place didn’t work.
