Lawdawz --------

Posted up tight on the land?

ans) yes , it is posted with signs all along the property boundary

No other way into the land that is not posted?

ans) Not unless they swim the swamp . I don't see and mud , etc on the bike tires

Family members?

ans) No .....no idea who they are

Neighbors kids?

ans) emailed pics to my friend . He doesn't know them as neighbors

Why do you have a camera on such an established trail, looking for trespassers?

Ans) because the deer are lazy like us and travel the easy route . I have posted pics of deer on this trail . It was made for the owner's ATV and he mows it when it is dry . He leaf blows one of the trails for duck season so he can get to the swamp quietly .

Do you live in a high crime area?

ans) No idea of the crime rate in Walworth and I subscribe to the Wayne Times

Had a lot of trouble with kids damaging property or stealing?

ans) Not on this property .......

Eddie, first let me say I'm a land owner and nothing pisses me off more than tresspassers. What does your Posted sign say? Some posted signs lack the language of what's not permitted on the land.

To me and many others ( I don't have statistics but I believe it's 97.3 percent ) understand that POSTED means " stay the hell out " unless you have permission to be here ....................

Posted from trespass?

Actually in NYS, anything other then land showing no usage or improvements of any kind is considered posted and unauthorized access is trespassing - although a conviction on a 1st violation will be unlikely.

-Now that's dedication.

-Not long ago as a youngster, I would never go onto posted property. Don't forget the kids not alone, if hes to stupid to realize its posted I would hope the older guy has a little bit more common sense. Its trespassing, I wouldn't react like he were dragging a deer out, but nether less he shouldn't be there.

So when you broke the law and trespassed it was ok but its not for these kids? ok got it.

I read all of you preach about getting kids involved in the outdoors all of the time, did any of you stop to think maybe these two have an interest and just maybe it would be better to try and teach them instead of throwing them in the proverbial slammer? If it were me I would try to find out who they are and offer to mentor them and maybe take them hunting and teach them about the outdoors and posted signs. Life is to short to get all fired up over two kids exploring the woods, don't any of you remember being kids once?

Back when I was a kid, very little property was actually posted, but I was raised to understand that I should have permission before entering someone's private property ..... posted or not. In fact I'll bet even the city kids knew better than cutting across their neighbor's yards even when that would have been much more convenient. We were taught not to assume that I had some kind of right to use other people's property. I guess in this day of permissivness and coddling, that little item of respect has been omitted for some and apparently with the blessings of others. No, there is no excuse for arbitrarily entering someone else's property without permission .... especially (but not exclusively) when it is posted. And that applies whether the trespasser is a kid, adult, or whatever.

As far as getting kids involved in the outdoors, I would suggest that the first lesson to be taught to these kids regarding outdoor activities is to respect landowner's property rights. They don't learn that by us making excuses for them to break trespass laws. I know it is fashionable to excuse everything that kids do these days, but that doesn't make it right.

Believe we had this discussion several months ago.

Didn't we detrmine that was the DEC's doctrine or definition...?

Again, I'll call "BS" on that! Private is private, whether corporate or individual landowners, improved or unimproved!

Permission to enter must be required regardless of the presence of posted signs or the actual verbage on them.

Seems like all these discussions have a common denominator; respect for others, their property & privacy or the total lack of!

If you want to pay the taxes on my property, you're welcome to tresspass. If not, stay out or ask first!

Unfortunately, believe we are just begining to see the tip of this iceberg...

BTW Eddie, had a similiar issue when I 1st bought my property with ATVs & horseback riders.

A posted sign in the center of their entrance path took care of my problem.

Ever heard the saying "Hey you kids get off of my lawn"? Your era was no different from now aside from not having trail cameras pointed in every direction, trespassing has gone on since the first land was owned, doesn't make it right but it also doen't mean its the downfall of todays generation. And I don't see where you can gaurentee you have never stepped foot on land you didn't have permission on unknowingly even as a young Doc running the woods.

"I would suggest that the first lesson to be taught to these kids regarding outdoor activities is to respect landowner's property rights"

I think I already said that didn't I?

Lets round up a posse and find this chubby safe kid with the helmet, he looks like he is in a hurry to steal some cookies or ice cream or something...little bastard! This country is going to hell in a hand basket thats for sure and its all because of them damn 12 year old tresspassers!!!

I don't doubt the ones who think it's okay to go anywhere they want or for Daddy and little Billy-Bob to do so are the same ones that wouldn't think twice about Trespassing on someone's property !

Teach kids to respect others and their property .

Doewhacker --- What part of it being a kid and an adult didn't you understand ? Apparently the Dad has no respect for property rights .

How does the land owner feel about them tresspassing? Is he going to call the dec?

I don't think trespassing violations are the DEC's realm , unless they involve fish and game violations or other conservation related issues.

The people to call would be the troopers or the Sheriff's dept. That's not saying a fish cop couldn't issue a ticket for trespassing, or any other violation ( even traffic tickets). It's just that they usually handle conservation and environmental stuff and leave the criminal issues to the state or county cops.

The Landowner doesn't want them there and isn't going to push the issue but would like to find out who they are . He is not going to call the DEC .

Not to speak for Doc and NYSlowhand but ....... we were brought up in an era where you obey the law . And yes Doewhacker , I have exceeded the speed limit at times so don't go there . Nowdays , it seems the attitude is ..... if you don't get caught or hollared at , it's okay .

You mean like Woodstock and the entire decade of the 60's or before that was any better? Yea things were really blissfull back then and no one ever broke a game law or tresspassed back then..nowadays the attitude is to convict some one of crimes instead of trying to talk your neighbors and figure things out. Thank goodness its not like that where I live, we all know each other and would talk face to face before calling the cops.

perhaps I missed something...where did Eddie say he was calling the cops?...He and the land owner have a right to be ticked off...they are paying for the privilege to work a trail and use it....What makes it OK for that kid and guy to do so?

When I was growing up we were taught not to go where you don't have permission...and if we did and the owner caught us...you can darn well bet we had are fannies chewed off but good...if not taken by the arm and escorted home...Today how ever you can't talk to a kid with out running the risk of child abuse charges...especially if ole Dad and mom want to talk the kid into embellishing...Before you start ...been there done that had a restraining order and arrested ...because the kids dog charged me and I raised my voice and threw a stone.....The kid ran home and next thing I know...the cops are at my door saying I told the KID I was going to snap her in two...long story and I won out and even my lawyer never sent a bill it was such BS...but still almost had guns seized....couldn't got to my kids school or drive up the road....the local justice kicked the cop out of court...we had to go through the county DA and he was pissed

So ppl Call the cops get good pictures and call the cops...talking to Mom and Dad could land you in trouble....kids word against yours today.....kid wins every time

it was never ok for me to trespass and i never said it was, i knew what the signs meant and respected what wasn't mine.

you never heard me preach about getting kids involved with the outdoors. so don't lump us all on in on that.

Come on everyone. It is a new world what belongs to you, now belongs to everyone and they can use it as they feel they want. BTW make sure you pay your taxes, so they can have the money to use for gas to get to your land. You rich bastards think you can buy something and keep it for yourself? I and everyone is entitled to use it as we see fit. Get used to it. :gaming:

Oh btw, this is tongue in cheek. I am an instructor, and one of the first things we teach is respect private property. This could happen in hunting season and if they got shot, the hunter would be in trouble. I can not believe that anyone could and would condone this behavior, and call them selves an ethical responsible hunter. If you condone this doewhacker, you should not be mentoring others. There I said it.

Bubba you are as stupid as you look, when did I condone it? Same old crap on here I guess, its better to go for blood then it is to actually talk to your neighbors and it is ok for some of you to do the same thing as kids but thats because the other generations were so much better and never did anything bad growing up. What a crock of s$&@! If a kid rides his bike through the woods on a trail one time I don't think we need to warm up the electric chair. Christ allmighty you guys are uptight. The funniest thing is if Ted Nugent breaks a law you run to his support but a kid on a bike needs the sherrif called on him. Doewhacker out!

off topic, but it was brought up. I like Ted's music, I think he is a freak of nature, and as far as him representing me in the field of hunting, not even close, and I never condoned his actions. Please show me one time I condoned him breaking the law? Just an attack to take the spotlight off your dumbass remarks. I am willing to bet doe that you don't even own the place you live in and probably lease a vehicle if you even have one. It sure did not take much to push your buttons, so I guess I hit close to home. If and I emphasize IF you ever own property of your own, I bet your outlook would be different. I do own land, and I figure since I pay the taxes on time every year, I have the right to say who does and does not come on it even if I do not have it posted. It is called land owner rights. But, as I stated you have no clue what that is I am sure. Did I say I would call the cops on the kid and the adult, umm nope. I said and will say again, They have no RIGHT to be there regardless of the reason.

Keep going Bubba, you really have me pinned down whimpering in my boots. Your attempts at bullying are weak at best you fat moron. I know some like you cannot understand anything other than grunts and whistles but maybe you can go back and reread where some folks want to throw the book at the kid and call the cops and dec.

As far as what I own, I would be more than happy to compare net worth with you any time idiot. What a blubbering child like dumbass you are. Have a blast getting yourself all worked up.
