  2. I think I have a deer problem. I've had the cameras out for the last few weeks in a main funnel area. The cameras are set up about 25 yards from my stand. Still a few nice bucks lingering around carrying head gear, and one freak that showed up after the season. Looks like one buck finally dropped his left side. Once I start to get a bunch of pictures of antlerless bucks I'll start walking around looking for sheds. Until then, the woods belong to them. In a few of the pics you can see the deer looking at my other camera.

You may have heard on the news about a Southern California man who was put under 72-hour psychiatric observation when it was found he owned 100 guns and allegedly had 100,000 rounds of ammunition stored in his home. The house also featured a secret escape tunnel. By Southern California standards, someone owning 100,000 rounds is considered "mentally unstable." In Michigan, he'd be called "The last white guy still living in Detroit.” In Arizona, he'd be called "an avid gun collector." In Arkansas, he'd be called "a novice gun collector." In Utah, he'd be called "moderately well prepared," but they'd probably reserve judgment until they made sure that he had a corresponding quantity of stored food." In Kansas, he'd be "A guy down the road you would want to have for a friend.” In Montana, he'd be called "The neighborhood 'Go-To' guy." In Alabama, he'd be called "a likely gubernatorial candidate." In Georgia, he'd be called "an eligible bachelor." In North Carolina, Virginia, Mississippi, Minnesota, Oklahoma, Wisconsin, Tennessee, Kentucky and South Carolina he would be called "a deer hunting buddy." And in Texas he'd just be "Billy Bob, who's a little short on ammo."

  4. Well geez... you doing all those things at a young age really does put things in perspective.. that changes my mind totally... I mean if you did illegal stuff when you were a kid it must be fine for everyone else... just the fond memories alone makes me want to support lawlessness... and the part about the hammer and safety glasses is epic... kind of opens my eyes to laws that I suddenly don't agree with... I could have created so many good memories with my kids when they were younger by stealing all the things they wanted for Christmas that I couldn't afford... and I certainly will feel better now about climbing the pole in front of the house to steal my cable TV... or running an extension cord to my neighbors to get free electricity... you have made me realize how I have been missing the boat all these years, Psst... I have to admit I did remove one of those tags off my mattress as a kid, so I suppose it is ok if some guy lets his underage kid shoot a deer then tag it illegally. I can't believe how easy it is to justify lawlessness... all you have to do is just say you broke the law once and it makes everything else fair game as well.

  5. This is what is so hard for me to believe. Having seen what it's like to live in a country where rights do not exist, I cannot fathom how ANY American citizen, gun owner or not, can think there is anything more important than protecting your freedom and challenging oppression. To be more concerned about trivialities like football stats or Hollywood stars, or even hunting, is a sign the political redirection policies of elected officials are working. The last thing American politicians want is people paying attention to everything they do. It's all about power and control. That power and control is supposed to be in the hands of the citizens, but many don't seem to want it. When they delegate it to politicians, they are willingly abdicating their rights and freedoms. Once that happens, they can never get them back.

  7. i'm really not trying to be a smart-alec. Its just that the NYSP are really pushing things a bit far by pre-empting the legislature and courts with their own wording and interpretations. The safe act did the following: Banned all magazines with >10 round capacity, including those previously grandfathered. Grandfathered in 10 rd mags that were possessed at the time the law took effect. Allowed for loading a max of 7 rds in a grandfathered 10 rd mag. Ten rounds can be loaded under specific circumstances (e.g. at a range) How that applies to items brought in from out of state, I don't know. How anyone can prove that a 10rd mag was/was not owned prior to 2013 I don't know. The Skretny decision ruled against the 7rd limit. My understanding is that NY falls under two different courts and due to that the Stretny decision only applies to part of the state. From a legal standpoint, the 7rd limit is still valid outside that jurisdiction. I think it technically still applies in the rest of the state, but most would agree that the Stretny decision makes it a non-issue. Then there's the overzealous cop/DA who could ruin your day. On top of this, Cuomo has supposedly said the NYSP would not enforce the 7rd rule.n (I haven't heard him say it myself). The LAW has not been amended by the legislature. although you could technically call the court ruling an amendment or sorts. What has been amended is the NYSP guide to enforcing this provision. I am not picking on jjb4900. What was posted is directly from the NYS website. I feel this distinction is very important. The NYSP do NOT have the authority to write or amend laws. Neither does the governor. Only the legislature can do that, and the the change must be signed into law by the governor. Barring that, a court ruling (such as Skretny) can alter the interpretation or application of the law - or even strike it down.. The NYSP has been making up their own BS on safe since day 1. They can interpret, stretch or add to the law all they want - it doesn't make it fact. Yes - in practice they can arrest you for anything they want. That doesn't make it legal, not does it mean it will hold up in court. Remember - the NYSP "guide" can change at any time. Cuomo wants to "crack down" or someone in Albany gets a cross hair up their backend and they could totally re-define what that guide says - without approval from the other branches of government. Just because some idiots in Albany decide "this is the law" doesn't make it the law. We need REAL reform (or repeal) of the safe act. The 7rd limit - along with plenty of other sections - need to go. Cuomo deciding to "not enforce" certain sections isn't good enough. All the "has been amended" hype is just to get people to shut up. "See - we fixed the law. Nothing to worry about!" It hasn't been fixed and we need to keep the pressure up. Answer to the original question - the limit is whatever they decide it to be. Either way, the empty 10rd mag should be fine under the law (with or without Skretny's ruling). To be extra sure, only load with 10 rds when at the range and you are 100% compliant with the text of the law. IANAL - this is NOT legal advice.

From what I read in most of this thread, what people find disturbing has a lot less to do with the content of the law than the fact that this guy is out there blatantly teaching his kid that game laws are to be ignored and disregarded, and that his teachings are also being backed up by some segment of the community. That attitude toward conservation law and perhaps other laws as well will be carried by that kid (and who knows how many other local kids) throughout his life of hunting. And that is disturbing.

  15. 22 inches so far. Getting a couple more before it's all done. Wind steady at 15 to 20. Gusts to 35. Drifts in spots over 4 feet. Temp right now at 3 degrees. Spent 4 and a half hours shoveling, snow blowing and plowing. A hot meal and a glass of brandy by the wood stove.....priceless!

  17. 10 rounders are fine you just can't load them all the way up with 10, if you plan to use that firearm to protect yourself or family with . That wouldn't be fair to the criminal on the other side of the door. You can only load 7 just like the criminal will. LOL!!! Cuomo ROCKS!!!

  18. I have traveled thru or visited most of the eastern states, mid-west, and some western states. It snows in Delaware. Slid down the sidewalks from dorm to classes in some storms when in college there. Sometimes end up with freezing rain instead of snow. Do have hurricanes come up the coast. Summertime lots of beach traffic. Sussex and Kent counties are the most rural counties - lots of chickens. No rifle hunting there. I'd say eastern Virginia or further south. But then your talking hotter summers and higher humidity. No snow - Florida Keys will work.

My daughter's partner is from the south. He doesn't get it. He thinks everyone should be polite - at least on the surface. My son lives in France. They all get it. Some call the French arrogant and badly mannered. I think they are normal. They have a reputation for disliking Americans but they all seem to like me. They make fun of our last name because it is a "four letter word" in French. They think the dumb Americans don't know what it is but we just laugh with them.

  21. If it is survivability we're talking I'd say a red bellied newt....they can regenerate some body parts....have enough neurotoxin to kill an adult human....also flash their red coloring to warn off predators and live in an area filled with tree hugging "granolas"...with pretty good weather.

  31. What you posted is crystal clear. Where did you get that text? It looks like an explanation/interpretation of the law, rather then the law itself. I have full text of the entire safe act and cannot find that wording anywhere. The actual section of the act regarding confiscation is in: "11. License: revocation and suspension." There is no "V. PISTOL PERMITS" section in the actual law (S2230-2013/A2388-2013). Again, I have no doubt they want to and will attempt to take away all guns whenever they have an opportunity. I am only asking where in the actual law is the text that give them the clear authority to do so. 11.(a)-© are the sections which deal with the mandatory surrender and reasons for it. I can see how some would want to read it that way, but I don't think it is clear either way, especially when other parts of the law are read and don't mention surrender of long guns. The only thing clear to me is that it is both a waste of time and a good reason for a court challenge. If not rendered unable to pass a NICS check, you could drive down to police HQ to surrender your shotgun and then buy a new one on the way home (legally). The safe act may provide for confiscation of long arms in certain situations, but it doesn't have language to preclude someone from future ownership of a rifle/shotgun. IMO, this adds an even stronger argument for my reading of the section. Confiscation from a "non-prohibited" person does nothing to "serve the public good" and is merely an unjust penalty applied to someone who has only been guilty of a "technical" rules violation (as opposed to a crime) without any due process.

  36. Unfortunately, there are many guys who do need 10 bullets to kill a deer. But it's not about hunting, it's about freedom and rights. I agree the majority of NY residents didn't stop and think what that statement meant, but I can assure you, much of the rest of "free" America heard it and are determined to prevent that virus from spreading to their states. Maybe after the smoke clears, NY will get it's gun rights back, but it will only be because much of America will refuse to allow that anti-gun attitude to migrate outside the borders of NY State.

  37. V. PISTOL PERMITS 1. Recertification Process The Safe Act has amended section 400.00 of the Penal Law to require that all pistol permits be renewed, or recertified, every 5 years beginning in January of 2014. Every existing permit holder will be required to recertify using a quick, free process that will begin in early 2014 on a staggered basis. Failure to recertify acts as a revocation of the license by operation of law. During the renewal process, the database will be checked to ensure that the licensee is still qualified to possess the weapon. Detailed recertification procedures are currently being developed and will be explained to all permit holders in 2014. 2. Pistol Permit records to be confidential / “Opt Out” Forms All state records relating to the Safe Act, including pistol permit renewal records, are specifically exempt from disclosure by statute. In addition, county permit records will not be subject to disclosure if the permit holder files an “Opt Out” form with the county. This form is available at http://www.nysafeact.comor http://www.troopers.ny.gov/optoutfoil. 3. Becoming ineligible at later time results in revocation If a licensee at any time becomes ineligible to hold a license, the license is considered to be revoked under an amendment to PL 400.00 (11). In such case, the person is required to surrender his or her license to the appropriate licensing official and any and all firearms, rifles or shotguns owned or possessed by the person must be surrendered to a law enforcement agency. EFFECT ON POLICE Removal of weapons not surrendered If the license and weapons are not surrendered, they will be removed by a police officer and declared a nuisance. At that point, the person would lose the ability to lawfully transfer the weapon. If a person becomes ineligible to hold a pistol permit, the Safe Act requires the person to surrender all firearms to police, including all rifles and shotguns for which no license or registration is required..........

  38. So much of the US Constitution was stepped on in the passing of the SAFE Act that it's hard to even begin to describe it. The right to due process is certainly one of them. It's almost easier to compile a list of basic Amercans' rights that weren't affected. Yet our elected officials take an oath to uphold those rights whenever they're sworn into office. Apparently they're 'just so many words' in a lot of cases. I worked for a boat builder years ago who also did some restoration work. After spending a few hours inspecting one of the restoration projects he said that the boat couldn't be fixed and that he would ask the owner if he wanted a new one built. The guys in the shop asked why the old one couldn't be fixed, and the reply was that the rot was just too deep.

  41. This is why NY gun laws are as bad as they are. Many NY gun owners just don't think they are bad, don't care about them, or are just oblivious to the encroachment. Carry on. Besides, nobody makes you read any of them. Why would you want to prevent equality of forum use because you disagree with the opinions of another member? That equality thing seems to be a problem with some residents of NY as well.

We all know that even with 100% reporting there will never be 100% accuracy because of the lack of integrity of some hunters to report truthfully... but I would think the margin of error would be much lower if everyone reported.. a simple method where if you don't report you don't get a license again until you do... that would go for the lifetime licenses as well... regardless of how you report, you must report... whether by phone, computer or in person... whichever turns out to be most economical for the DEC. Everyone that hunts must buy a license each year.. that is when the reporting must be done (for lifers maybe by phone).. BUT.. no matter how, you don't get the new years tags until you do. .. like Doc says, in this day of computers there shouldn't be a lot of cost involved.

  43. Hunting at home, with a bow, or ML, I would target the doe first, with a center-lung shot. Here, in the NW part of the state, the local deer population is well above optimum. With a repeating rifle or shotgun, I would first target the shoulder blade of the doe, anchoring her on the spot, then go to the largest fawn, with a center-lung shot. I prefer to send them to deer-heaven (our families food supply) together if I have the tags and means do so quickly and cleanly. I average a button-buck every other year or so, and most are taken with this method, immediately or shortly after their mammas. There are no deer that are finer eating, especially the livers, than them 6 month old bucks and does. I do hunt one area where the local deer population is a usually a little under optimum (NW Adirondacks) several times a season. Up there, during the early archery season, or ML, I would certainly look to take the fawn first, especially if it was a buck-fawn. Usually I am in for a long, manual drag, so it is less work for me that way. I like to leave the does around up there, as they are the key to getting chances at them big mountain bucks, one of which I was finally able to score on this past season.
